Qué debe saber de la asistencia familiar

El objeto principal de la asistencia familiar es procurar el desarrollo integral del beneficiario en aspectos como la alimentación, salud, educación, vivienda, recreación y vestimenta

En el modelo nacional de las leyes existen muchas dudas en distintos casos legales, en algunos no se recurre a un especialista en asuntos jurídicos por miedo o por lo económico, es por esta razón que el abogado Leónidas Gutiérrez Argandoña, abogado que atiende procesos civiles y familiares, despeja algunas dudas sobre procesos vinculados con la familia puesto que existen muchos casos de asistencia familiar.

CÓDIGO DE FAMILIA
El actual Código de las Familias da un concepto de Asistencia Familiar en su artículo 109 (contenido y extensión de la asistencia familiar): “La asistencia familiar es un derecho y una obligación de las familias y comprende los recursos que garantizan lo indispensable para la alimentación, salud, educación, vivienda, recreación y vestimenta; surge ante la necesidad manifiesta de los miembros de las familias y el incumplimiento de quien debe otorgarla conforme a sus posibilidades y es exigible judicialmente cuando no se la presta voluntariamente; se priorizará el interés superior de niñas, niños y adolescentes”.

El objeto principal de la asistencia familiar es procurar el desarrollo integral del beneficiario en varios aspectos como son alimentación, salud, educación, vivienda, recreación, vestimenta etc. Asimismo, le da un valor de derecho a percibir la asistencia por parte del beneficiario y una obligación por parte de la persona que la va a proveer, toma en cuenta los ingresos económicos de la persona que va otorgar esta asistencia y la novedad en el Código es que da un parámetro de cuál es el monto mínimo de la misma en el artículo 116 sobre la fijación de la asistencia familiar.

En el numeral IV se estipula que “en los casos en que exista un ingreso mensual igual o menor al salario mínimo nacional sea fijo o no, o en los casos en que el ingreso anual sea equivalente por mes al salario mínimo, el monto calificado no podrá ser menor al veinte por ciento (20%) del salario mínimo nacional, y se incrementará si existiere más de una beneficiaria o beneficiario de acuerdo a sus necesidades”.

En este artículo podemos verificar que da pie al incremento de acuerdo a las necesidades del beneficiario o beneficiarios.

Recordemos que los hijos en nuestra actual legislación son todos iguales y están en la misma jerarquía, lo que quiere decir que basta que esté con el nombre de los padres en el certificado de nacimiento ya se hace beneficiario con una asistencia, sea voluntaria o judicial, en determinados casos.

Entrando al tema, vamos a hablar de una forma en la que se establece la asistencia familiar en la que existe un documento, ya sea privado (firmado entre particulares) o público (reconocido en sus firmas ante autoridad competente), mediante el cual se establece un monto de asistencia familiar a favor de un beneficiario.
